Management contract

If there is a management agreement, all legal and financial responsibility for the hotel’s operation remains with the owner and the owner’s representatives. In essence, it is an agreement for the provision of consultancy services.

The sole executive body (SEB)

The management contract and the agreement for the exercise of the functions of the SEB are similar in many ways, with the SEB agreement legally placing more responsibility on the Managing Company.

Lease agreement

All responsibility both for the operating activity and renewal of the operating assets of the hotel rests with the Managing Company. The owner receives lease payments as per the agreement and is responsible for maintaining the structural elements of the hotel building in working condition.

The cost of services related to management

The cost is determined individually in each case and depends on the parameters of the hotel itself: its location, its total room’s capacity, the number of its restaurants, bars, and conference halls, and the volume of additional services. In general, the cost of services related to management may not be less than 2% of revenue plus 5% of gross operation profit. As regards the lease rate, there are no general rules and things are rather individual. Having said that, we readily go for such a format for determining the lease rate as “a percentage of revenue but not less than…” There is a particular lower limit established on the rental which the owner will get in any case, and subsequently lease payments can increase as the hotel revenue grows.
